Enforcement Process

Learn how your HOA enforces its governing documents, including the steps taken when a violation occurs, how homeowners are notified, and how to resolve or appeal a violation.

Overview

The enforcement process ensures that all homeowners follow the community’s CC&Rs, Rules and Regulations, and architectural standards. This process helps maintain property values, protect community appearance, and ensure fair treatment for every resident.

The goal of enforcement is always compliance, not punishment. The process is designed to be fair, transparent, and consistent with the Indiana HOA Act and your community’s governing documents.

How a Violation Is Identified

Violations may be identified in several ways:

  • Routine inspections conducted by the Property Support Team

  • Reports from other homeowners

  • Direct observation by the Board of Directors or management team

Once a potential violation is confirmed, it is documented and entered into the association’s system for tracking and follow-up.

Notification Process

  1. Courtesy Notice: A friendly reminder is sent describing the issue and requesting correction within a specific timeframe. Many issues are resolved at this stage.

  2. Formal Violation Notice: If the issue is not corrected, a formal notice is issued outlining the specific rule violated, the deadline to correct it, and the possible fine or hearing process.

  3. Fine or Hearing Notice (if applicable): If the violation remains unresolved, the homeowner may be invited to a hearing before the Board or fined according to the association’s adopted policy.

  4. Legal Action (rare): In serious or repeated cases, the association may pursue further enforcement through legal channels, as permitted by the governing documents.

All notices are sent to the homeowner’s address on record and are also available in the homeowner portal for reference.

Homeowner Rights and Hearings

Homeowners have the right to respond to any violation notice and, if applicable, request a hearing before the Board of Directors. During the hearing, the homeowner can explain the situation and present evidence. The Board then determines whether further action is necessary.

Resolving a Violation

To resolve a violation:

  1. Correct the issue within the time allowed.

  2. Notify the Property Support Team once the correction is complete (include photos if applicable).

  3. The team will verify and close the violation in the system.

Once resolved, the violation is documented as closed and will not appear as active on your account.
