Overview

Rules and Regulations are adopted by the Board of Directors to provide clear expectations for daily life in the community. They supplement the CC&Rs by addressing specific situations that may not be detailed in the original governing documents. The goal of these rules is to promote fairness, safety, and consistency for all homeowners.

Purpose of the Rules and Regulations

While the CC&Rs establish the overall standards for the community, the Rules and Regulations help define the details. They make it easier for homeowners to understand what is allowed and how to remain in compliance with the association’s policies.

Examples include:

  • Parking and vehicle restrictions

  • Pet policies

  • Trash and recycling requirements

  • Amenity use (pool, clubhouse, playgrounds, etc.)

  • Exterior maintenance expectations

How Rules Are Created and Updated

The Board of Directors has the authority to adopt and amend Rules and Regulations as needed, as long as they do not conflict with the CC&Rs or state law.

When new rules are proposed, the Board typically:

  1. Reviews the issue and drafts a proposed rule.

  2. Distributes notice to homeowners for review or comment.

  3. Votes on adoption during a Board meeting.

  4. Posts the approved rule in the homeowner portal under Documents.

Once adopted, all homeowners are required to comply with the new or updated rule.

Enforcement of Rules

The management company and Board work together to ensure that Rules and Regulations are applied fairly and consistently. If a violation occurs, a written notice will be sent to the homeowner outlining the issue, corrective action, and appeal process.

The association’s Violation and Fine Policy (if applicable) describes the steps and timeframes for resolving any issues.
