Fines are used by the association as a last resort to encourage compliance when violations are not corrected after multiple notices. The fine policy ensures fairness and consistency by following clear procedures established in the governing documents or formally adopted by the Board of Directors.
Fines are not intended to punish but to promote prompt correction of violations and protect the appearance and value of the community.
How the Fine Policy Works
Each association’s fine policy may vary slightly, but it generally includes:
The amount of each fine
The number of days allowed to correct a violation before a fine is applied
How repeat violations are handled
The process for hearings and appeals
Fines are only issued after the homeowner has received proper notice and an opportunity to correct the issue.
Common Fine Structures
While specific amounts are determined by your community’s policy, typical examples include:
$25 per occurrence or per day until resolved
Escalating fines for repeat violations (for example, $25, then $50, then $100)
A one-time fine for major violations such as unapproved construction
Fines are added directly to the homeowner’s account in the PayHOA portal, where they can be viewed and paid like any other charge.
Notice Before Fining
Before a fine is applied, the association must provide written notice stating:
The rule or restriction was violated
The corrective action required
The deadline to comply
The amount of the potential fine and the date it will begin
The homeowner’s right to a hearing before the Board
This ensures due process and gives every homeowner the opportunity to address the issue or present an explanation.
Hearings and Appeals
Homeowners have the right to request a hearing before the Board of Directors to contest a fine or explain extenuating circumstances.
To request a hearing:
Submit your request in writing within the timeframe listed in your violation notice.
Include your name, property address, and the violation reference.

The Board will review your case and issue a written decision after the hearing.
Fine Removal or Adjustment
If the violation is corrected promptly after a fine is issued, or if the homeowner demonstrates a good faith effort to comply, the Board may choose to waive or reduce the fine at its discretion.
Nonpayment of Fines
Unpaid fines may accrue interest or lead to further collection action, as permitted by the governing documents. Continued noncompliance may also result in suspension of voting rights or amenity access, depending on association policy.
